The case concerned 16 property owners, whose properties are located on Aglantzias Avenue in Nicosia.

In November 2015, a requisition order was published to carry out works for the improvement and widening of Aglantzia Avenue.

In November 2015, an acquisition order was also published in the Official Gazette of the Republic for the same properties and for the same purpose.

It is solid law however that a requisition order can only, and must only be used as an urgent and necessary purpose. Also, any changes made to a property that is requisitioned should not be permanent but only temporary.

As such, we filed an appeal to Administrative Court in 2016 and requested the cancellation of the requisition order.

The Administrative Court accepted and agreed with the legal position and arguments raised by Mr. Dilinos and cancelled the requisition order by reiterating that a requisition order should only be used when the matter is urgent.
