According to the 2003 Larnaca Regional Plan the disputed properties that were part of the Ka6 Zone, which is residential, would have changed planning zone and be part of the A4 Zone, which is the School Construction Zone.
The owners objected that provision to the Department of Urban Planning. The Committee that is set to examine the Objections suggested “striking down” the objections. The Town Planning Council agreed with their suggestion and proposed to the then Minister of Interior to reject the objections.
Their objections were rejected, and the Larnaca Regional Plan was approved.
As such, in 2007 the property owners through our law firm filed Appeals against the Republic of Cyprus for the cancellation of the Larnaca Local Plan.
In 2010, the Court of Appeal, rejected the objections raised by the Republic of Cyprus and agreed with Mr. Dilinos suggestions. As a result, the Court ordered the annulment of the Larnaca Regional Plan.
